Tax benefit for micro and SMEs that adhere earlier to the QR Code on invoices

Companies will have a tax benefit on expenses with the implementation of the accounting SAF-T and the placement of QR and ATCUD codes on invoices, this being the greater the sooner these adaptations are implemented.

The measure provides for increases in the deduction of expenses incurred by companies in the process of adapting and implementing the obligations arising from the submission of the SAF-T file, relating to accounting, and the placement of the QR Code and ATCUD on all invoices.

The tax benefit can reach up to 140%

  • 140% of expenses incurred and accounted for until the end of the first quarter of 2021;
  • 130% of expenses incurred and accounted for until the end of the first half of 2021;
  • 120% of expenses incurred and accounted for until the end of 2021;

According to the proposal, expenses with the acquisition of goods and services directly necessary for the implementation of the SAF-T related to accounting are considered at 120% if it is completed by the end of the 2021 tax period.

In the case of QR Code and ATCUD, implementation expenses are also considered at 120% provided these codes appear on all invoices and other tax-relevant documents as of 1 January 2022.

This tax benefit is considered “in 140% of the expenses recorded, on condition that the taxable person starts to include the QR code in all their invoices and other fiscally relevant documents until the end of the first quarter of 2021” and “in 130% of the expenses accounted for in the period, on condition that the taxable person starts to include the QR code on all their invoices and other tax-relevant documents by the end of the first half of 2021”.

“In cases where expenses are related to assets subject to decay, the tax benefits referred to in the previous numbers are applicable to expenses recorded in relation to amortization and depreciation during the useful life of the asset”, the measure also emphasizes.

This increase in expenses is only applicable to micro, small and medium-sized companies and expenses incurred as of January 01, 2020.

“If the taxable person does not complete the implementation of the SAF-T, regarding accounting, the QR code or the ATCUD by the end of the respective periods referred to (...) the increases unduly considered in previous tax periods must be added in the determination of profit taxable amount of the tax period in which such non-compliance occurred, plus 5% calculated on the corresponding amount”, the proposal also reads.

It is recalled that according to the timetable that is established, the sending of the IES/DA and the submission of the SAF-T (PT) file, related to accounting, is only applicable to the IES/DA of the 2021 and subsequent periods, the deliver in 2022 or subsequent periods.

The registration of the QR Code and ATCUD on invoices is optional during the year 2021, becoming mandatory from January 01, 2022. For some companies, it was planned to be mandatory from January 01, 2021.
